Terms of Service

Welcome to Proofset! These Terms of Service ("Terms") govern your use of the Proofset mobile application ("App") operated by Harry Stoltz ("we," "us," or "our").

By downloading, installing, or using Proofset, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Proofset is a mobile application that converts photographs of handwritten mathematical notes into LaTeX code and PDF documents using artificial intelligence. The service includes:

• Image capture and import functionality
• AI-powered conversion of handwritten math to LaTeX
• PDF generation from LaTeX code
• Document storage and management
• Export and sharing capabilities

2. Account Registration

To use Proofset, you must create an account using either:

• Sign in with Apple
• Email and password

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

3. Subscription Plans and Payment

Free Tier

All users receive 20 free pages per week. This limit resets every Monday at midnight UTC.

Pro Subscription

The Pro subscription provides 200 pages per week and is available for a monthly fee. Subscription details:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription in your Apple ID Account Settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to circumvent usage limits or subscription requirements
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the service
• Upload content that infringes on intellectual property rights of others
• Interfere with or disrupt the integrity or performance of the App
• Attempt to gain unauthorized access to the App or its related systems

5. Intellectual Property

Our Property

The App, including its design, features, and content (excluding User Content), is owned by us and is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any images you upload and the resulting LaTeX/PDF documents ("User Content"). By using the App, you grant us a limited license to process your User Content solely for the purpose of providing the service to you.

6. Privacy

Your use of Proofset is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• The AI conversion will be 100% accurate for all handwritten content
• Any errors in the App will be corrected

You acknowledge that AI-powered conversion may contain errors and you are responsible for reviewing and verifying all output before use.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any errors, mistakes, or inaccuracies in the converted content
• Unauthorized access to or alteration of your transmissions or data
• Any other matter relating to the App

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Harry Stoltz and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and User Content
• Provisions that by their nature should survive termination will survive

You may delete your account at any time through the App settings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms in the App or via email. Your continued use of the App after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
